The type of labor law posters an organization or business requires depends heavily on the nature of a business, the state in which it operates and the amount of employees an organization employs. But knowing which labor law posters your business requires and distinguishing between the different Federal, State and industry-specific labor law posters can be a very difficult process which is why we have simplified it for you in a list of the different types of labor law posters below.

Federal Labor Law Posters

In the U.S. there are a handful of mandatory labor law posters every employer is required to obtain. This includes the OSHA poster, also known as the “Job Safety & Health Protection” It’s the Law” poster which stipulates the health and safety procedure and regulations for both employers and employees, the USERRA poster which outlines the rights, benefits and obligations of employees within the workplace, the Employee Polygraph Protection Act which prevents private employers from using polygraph tests for employment-screening or during the course of employment, and the Employee Rights Under the Fair Labor Standards Act poster that establishes the minimum wage and overtime pay employees are entitled to.

These labor law posters do not make up the complete list of federal labor law posters, there are a few more federal labor law posters but they are mandatory for some employers only. For example, public agencies are required to post the Family and Medical Leave Act, while employers of people with disabilities are required to post the Notice to Workers with Disabilities, also known as the Employee Rights for Workers with Disabilities Paid at Subminimum Wage poster.

State Labor Law Posters

Every state in the U.S. has its own set of mandatory labor law posters that employers are required to obtain and display in their workplace. For example, in Delaware the state compiled an all-in-one labor law poster called the Delaware-Department of Labor-Division of Industrial Affairs poster which contains all the state’ necessary labour law posters for employers to post. Yet in New Hampshire, mandatory state labor law posters are entirely separate and employers need to obtain each independently. Some of them include the New Hampshire Minimum Wage Law poster, the Protective Legislation Law poster and the Whistleblowers’ Protection Act poster to mention a few. Like New Hampshire, the State of Virginia also has separate state labor law posters but Virginia’s mandatory state labor law posters are slightly different to those of New Hampshire. Virginia’s mandatory poster includes an Unemployment Insurance poster, Virginia’s Workers’ Compensation poster, and a Life’s a Little Easier with EITC poster which tells employees how they can qualify and file federal tax returns. It is difficult to say which state labor law posters a business may require without first knowing in what state the business intends to operate, once you know that you can easily determine which ones are relevant to your business.

Industry-specific Labor Law Posters

Aside from the federal and state labor law posters employers are required to obtain, there are also industry-specific labor law posters that employers need to think about. If we take the agricultural industry as an example we will see that agricultural employers required three additional labor law posters, the Notice of the Migrant and Seasonal Agricultural Worker Protection Act, the Agriculture Under the Fair Labor Standards Act poster and the Employee Rights Under the H-2A Program poster. Like the agricultural industry, every industry has its own set of mandatory labor law posters that employers are by law required to obtain.
